Prize Terms & Conditions
Prizes not claimed within thirty (30) business days or in the case of a time sensitive prize, within its period of usability if shorter than 30 business days, shall be considered forfeited (without notice to the winner) and will become property of FocusFest. Such prize may be disposed of at the discretion of Event Management.
FocusFest reserves the right, but not the obligation, to cancel or modify the prize drawings and shall not be required to award a substitute prize. Non-cash prizes are not redeemable for cash. No transfer or assignment of prizes is allowed, except as may be determined by FocusFest in its sole and absolute discretion on a case by case basis.
Winners are responsible for paying all applicable local, county, state and federal taxes on prizes based on the estimated retail value of the prize, as set forth in the contest rules, and may be issued an IRS 1099 form for all prizes won from FocusFest where the aggregate value of all prizes is $600 or more in any calendar year.
Any prize including, but not limited vouchers, gift certificates and/or gift cards donated by event sponsors are not the responsibility of FocusFest. FocusFest is not responsible for replacing or reimbursing winners with any form of compensation should the vendors/sponsors default on their obligations. Gift certificates may have an expiration date and use of such certificate may be based on availability and include black-out periods, restrictions or excluded items (for example, tax, tips, alcoholic beverage, or goods from a particular manufacturer). Gift certificates are only redeemable at the locations for which they are specified.
By participating in a FocusFest prize drawings, entrants hereby agree and each entrant hereby remises, releases and forever discharges and agrees to indemnify and hold harmless FocusFest, its affiliates, parents, assigns, successors, employees, sponsors, agents and all others connected with them and the promotion, contest, and/or event from any and all liability, claims, actions, and damages sustained or incurred by participation in the said promotion, contest, and/or event and the receipt and use of any prize(s) awarded (if any) through such promotion, contest, and/or event arising in any manner whatsoever, including but not limited to an act or omission, whether negligent, intentional or otherwise caused by FocusFest, its affiliates, parents, assigns, successors, employees, sponsors, agents and all others connected with them and the promotion, contest, and/or event.
Winners are prohibited from selling any prize awarded or transferring any prize without FocusFest's authorization (which authorization must be in writing by a FocusFest representative and shall be granted or withheld in FocusFest's sole discretion on a case by case basis). In the event that FocusFest discovers or suspects (correctly or incorrectly) that a winner is attempting to sell his/her prize from FocusFest (i.e., ebay, craigslist or otherwise), FocusFest reserves the right, in its sole discretion, on a case by case basis to take any one or more of the following actions: (a) immediately disqualify the winner and deem any prize they were otherwise entitled to as forfeited, (b) refuse to award the prize to such winner, even if he/she represents that they will not resell or transfer the prize, and/or (c) prohibit the violating winner from participating and/or winning any future FocusFest prize drawings (whether for a fixed period of time or in perpetuity, in FocusFest's sole discretion) and if such winner ever wins a future FocusFest prize drawing during the period that he/she is banned, he/she shall be disqualified from the prize drawing and forfeit any prize once it has come to FocusFest's attention. Further, FocusFest reserves the right to track and/or cancel and invalidate any prize awarded that FocusFest suspects was sold or transferred without authorization.
FocusFest is not responsible for any misprint or typographical errors. If, for any reason, in the sole opinion of FocusFest, any prize drawing/giveaway is not capable of running as planned by reason of sponsors, vendors, unauthorized intervention, fraud, technical failures, weather or any other causes, whether discovered or suspected by FocusFest. FocusFest reserves the right, at its sole discretion, to cancel, terminate, modify or suspend the affected prize drawing(s) and/or any portion of any prize drawing(s) with or without selecting qualifiers, finalists or winners, and/or provide alternative means of reimbursements or any other changes to these rules that FocusFest deems appropriate under the circumstances.
Winners represents and warrants that he/she authorizes FocusFest to post their photos and name on FocusFest's website or social network sites.
Gift/Goodie Bags
Goodie bags are non-refundable within 15-days prior to the event date. If you have purchased a goodie/gift bag and no longer able to attend FocusFest, please contact us 15-days before the event for information on shipping arrangements. Attendees who do not pick up their goodie/gift bag at the event will forfeit the merchandise. No refunds are allowed.
Event Rules & Regulations
Glass containers, alcoholic beverages, illegal substances, and firearms, are not allowed at FocusFest. Smoking is prohibited in buildings located at FocusFest.
Attendees are required to dispose of trash in proper waste receptacles.
No honking of horns, air horns or alarms are allowed.
Music is not to exceed 75 db. Any music must remain within the confines of your space or played at a level not to interrupt the business of surrounding vendors.
Proper dress code will be enforced during the event. No gang attire will be allowed. FocusFest reserves the right to refuse service to anyone.
All winners must be present at the Awards Ceremony in order to receive their awards. If your name is called and you are not present, the award will be given to the next person in line.
All dogs at FocusFest must be on leash and controlled at all times. Vaccination records must be made available upon request. Owners shall be responsible for waste cleanup and disposal in receptacles provided.
These rules, regulations, and schedules are subject to change depending on weather, time and venue locations without notice.
Online Registration
FocusFest may use cookies and/or collect IP addresses (an IP address is a number that can uniquely identify a specific computer or other network device on the internet) for information purposes, identifying your location (including, without limitation, to re-direct you to the appropriate geographic website, if applicable) or for any other lawful purpose in accordance with FocusFest's privacy policy.
